Terms and Conditions of Accommodation

Article 1. Scope of Application

  • Contracts for Accommodation and related agreements to be entered into between The Lobs and a Guest to be accommodated shall be subject to these Terms and Conditions and the Rules and Regulations integral thereto. Any particular not provided for in these Terms and Conditions or the Rules and Regulations integral thereto shall be governed by the laws, regulations or generally accepted practices of Japan.
  • In the case where The Lobs has entered into a special contract with the Guest, insofar as such a special contract does not violate laws, regulations or practices of Japan, notwithstanding the preceding paragraph, the said special contract shall take precedence over the provisions of these Terms and Conditions.

Article 2. Application for Accommodation Contract

  • A Guest who intends to make an application for an Accommodation Contract with The Lobs shall notify The Lobs of the following particulars.
    • Name(s) of the Guest(s);
    • Date of accommodation and estimated time of arrival;
    • Accommodation Charges (based, in principle, on the Basic Accommodation Charges listed in the Attached Table 1); and
    • Other particulars deemed necessary by The Lobs.
  • If there is any change in the particulars given in the application to the Accommodation as listed above in the preceding paragraph, the Guest shall inform The Lobs of such a change immediately.
  • In the case where the Guest requests, during his/her stay, an extension of the accommodation beyond the date(s) in Subparagraph (2) of Paragraph 1 above, The Lobs shall handle his/her request as an application for a new Accommodation Contract at the time such a request is made.

Article 3. Conclusion of Accommodation Contract and Related Matters

  • A Contract for Accommodation shall be deemed to have been concluded when The Lobs has duly accepted the application as stipulated in the preceding Article; provided, however, that the same shall not apply when it has been proven that The Lobs has not accepted the application.

 

Article 6. Refusal of Accommodation Contracts

  • The Lobs may not accept the conclusion of an Accommodation Contract under any of the following cases:
    • When the application for accommodation does not conform to provisions of these Terms and Conditions;
    • When The Lobs is fully booked and no room is available;
    • When circumstances apply similar to the preceding paragraph, including compelling prospects that guest rooms will have to be let on a preferential basis to disaster victims and recovery crews, etc., due to the outbreak of a disaster or some other state of emergency;
    • When the Guest seeking accommodation is deemed to be a member of or be related to an organized crime group, a group related thereto or any other antisocial organization which is provided for in the Act on Prevention of Unjust Acts by Organized Crime Group Members and the prefectural ordinances concerning the exclusion of organized crime groups;
    • When the Guest seeking accommodation is deemed liable to conduct him/herself in a manner that will contravene the provisions of laws and regulations or act against public order or good morals in regard to his/her accommodation;
    • When the Guest seeking accommodation is clearly identified as carrying an infectious disease;
    • If, in connection with the use of a guest room, The Lobs is required to provide services beyond the generally accepted scope or to bear such other burden;
    • When The Lobs is unable to provide accommodation due to natural calamities, malfunction of facilities and/or other unavoidable causes;
    • When the Guest seeking accommodation is deemed likely to cause annoyance to other guests or interfere with the operations of The Lobs, or engages in speech and/or action that cause severe annoyance to other guests or personnel of The Lobs, due to intoxication or other causes;
    • When the Guest seeking accommodation is clearly identified as having a mental or physical disorder;
    • When the Guest(s) seeking accommodation is a minor (or are minors) unaccompanied and unauthorized by a guardian;
    • When the application for accommodation is made for the purpose of transferring the right of use to another party;
    • When the Guest seeking accommodation has made an application for accommodation though he/she has no intention to actually stay in the room; or
    • In other cases that fall under the stipulations of laws and regulations, prefectural ordinances and other provisions.

Article 7. Right to Cancel Accommodation Contracts by the Guest

  • The Guest is entitled to cancel an Accommodation Contract by notifying The Lobs.
  • In the case where the Guest has cancelled the Accommodation Contract in whole or in part due to causes for which the Guest is liable (except in the case where The Lobs has requested the payment of the deposit during the specified period as prescribed in Paragraph 2 of Article 3 and the Guest has cancelled the Contract before the payment), the Guest shall pay cancellation charges as listed in the Attached Table 2; provided, however, that in the case The Lobs has entered into a special contract described in Paragraph 1 of Article 5, this provision shall apply only when The Lobs has notified the Guest of his/her obligation to pay the cancellation charges for cancellation of the Accommodation Contract when accepting the special contract.
  • In the case where the Guest does not appear at the expected time of arrival without advance notice, The Lobs may regard the Accommodation Contract as being cancelled by the Guest.

Article 8. Right to Cancel Accommodation Contracts by The Lobs

  • The Lobs may cancel the Accommodation Contract under any of the following cases:
    • When the Guest is a member of or related to an organized crime group, a group related thereto or any other antisocial organization which is provided for in the Act on Prevention of Unjust Acts by Organized Crime Group Members and the prefectural ordinances concerning the exclusion of organized crime groups;
    • When the Guest engages on the premises of The Lobs in violence, threats, extortion, undue demands, gambling, possession or use of controlled substances, firearms, swords, or similar articles, or commits acts causing annoyance to other Accommodation guests, or other acts in contravention of laws and regulations or public order and morals, or is likely to engage in any of the foregoing;
    • When the Guest is clearly identified as carrying an infectious disease;
    • If, in connection with the use of a guest room, The Lobs is required to provide services beyond a reasonable scope or to bear such other burden;
    • When The Lobs is unable to provide accommodation due to natural calamities, malfunction of facilities and/or other unavoidable causes;
    • When the Guest commits an act that interferes with fire prevention or protection, such as smoking on the premises or tampering with fire fighting or other equipment;
    • If the right to use the guest room is transferred or attempted to be transferred to another party;
    • In cases where Accommodation Contracts are entered into through travel agencies, if payment of the Accommodation Charges by such an agency is unconfirmed; where unconfirmed payments of Accommodation Charges include payments made by money transfer shortly before the end of banks’ business hours, or made through Internet Banking regardless of banks’ business hours, when the execution of money transfers is unable to be ascertained on that date owing to the following day being a bank holiday;
    • When the Guest has violated any provision of these Terms and Conditions or the Rules and Regulations of The Lobs; or
    • In other cases where the provisions of laws and regulations or prefectural ordinances, etc. can apply which stipulate the Accommodation’s right to refuse to accept the Guest.
  • The notice of cancellation in any of the cases listed above in the preceding paragraph shall be given orally, or by telephone or electronic mail or in writing to the Guest according to the contact information provided pursuant to Article 2. If the said notice has not reached the destination though given according to the contact information provided pursuant to Article 2, it shall be regarded as having reached the destination when the time at which the notice should have normally reached the Guest has passed.
  • Except in the cases of (3) and (5) in Paragraph 1 above, the Accommodation Charges are not refundable if The Lobs has terminated the Accommodation Contract in accordance with the provisions of the preceding two paragraphs.

Article 9. Registration

  • The Guest shall register the following particulars at the front desk of The Lobs on the day of accommodation:
    • Name(s), age(s), address(es) and occupation (s)of the Guest(s);
    • Nationality, passport number, a photocopy of the passport, and a valid credit card for incidental charges;
    • Date and scheduled time of departure; and
    • Other particulars deemed necessary by The Lobs.
  • In the case where the Guest intends to pay his/her Accommodation Charges by any means other than cash in Japanese currency, such as accommodation coupons or credit cards, such means of payment shall be shown in advance at the time of the registration prescribed in the preceding paragraph.
  • The Guest shall provide credit card details as security on check-in prior to use of a guest room of The Lobs. No Guest can check-in to the room until The Lobs has credit card details and authorization for use as a Security Deposit.

Article 10. Occupancy Hours of Guest Rooms

  • The time allowed for the Guest to use a guest room of The Lobs shall be between the check-in and check-out times specified by the Accommodation, except when the Guest stays for more than one night in succession, in which case the Guest may use the guest room all day except the day of arrival and the day of departure; provided, however, that the same shall not apply in the case where the Guest changes a room.
  • The Lobs may, notwithstanding the provision prescribed in the preceding paragraph, permit the Guest to occupy the room beyond the times prescribed in the same Paragraph, in which case extra charges shall be paid as specified by The Lobs.
  • While the guests are permitted to use guest rooms during the hours set forth in the preceding two paragraphs, The Lobs reserves the right to access guest rooms and take necessary measures for purposes of safety, sanitation or any other administrative management by The Lobs.

Article 11. Cleaning of Guest Rooms

  • Cleaning, Linen and Towels, Rubbish Linen and Towels: The accommodation will provide clean towels and linen for each booking. Additionally, complimentary coffee, tea bags, hand soap, body soap, shampoo, toilet paper, and tissues will also be provided. Rubbish Removal: Every day the trash will be removed
  • Mid-Stay Clean: For bookings of 8 nights or more and if check out is not the next day. A mid-stay light clean will be conducted on the 6th day. This clean will include the removal of rubbish, fresh linen and towels, and cleaning of bathrooms and floors.
  • On days other than the scheduled full clean, there will be no cleaning provided.
  • House keeping rules

Your beds will not be made up every day, and your kitchen will not be cleaned during your stay. If you would like extra cleaning, you may arrange it with our Reservations team in advance, or Front Desk when you are in house. Extra cleaning has associated fees that vary based on room type.

Article 12. Liabilities of the Guest

  • In the case that The Lobs has incurred the expenditure of the cleaning or repair expenses of the guest room, the loss of a sales opportunity, or any other damage due to the Guest’s breach of these Terms and Conditions or Rules and Regulations or any other reason attributable to the Guest, he or she shall compensate The Lobs for the said damage.
  • The Guest shall provide the information of a valid credit card thereof as security for use of The Lobs.
  • The Guest shall authorize The Lobs to charge all fees and charges properly chargeable to the Credit Card presented above in the preceding paragraph, according to the provisions.

Article 13. Observance of Rules and Regulations

The Guest shall observe the Rules and Regulations established by The Lobs, which are posted within the premises of The Lobs.

Article 14. Business Hours

  • The main business hours of various facilities of The Lobs will be notified by such means as the brochures provided in the building, notices posted in various places, and service directories in guest rooms.
  • The business hours of the facilities, set forth in the preceding paragraph, are subject to temporary changes due to unavoidable causes, in which case the Guest shall be informed by appropriate means

Article 15. Payment of Accommodation Charges

  • Accommodation Charges, etc. as stated in the preceding paragraph shall be paid as a form of currency or by other alternative means as shall be acceptable to The Lobs, such as accommodation coupons or credit cards, at the time of the Guest’s arrival or upon request by the Accommodation.
  • Accommodation Charges shall be paid even if the Guest voluntarily does not utilize the guest room once such a guest room has been made available to him/her by the Accommodation.

Article 16. Handling When Unable to Provide Contracted Rooms

  • The Lobs shall, when unable to provide the contracted room(s), arrange another accommodation of the same standard elsewhere for the Guest insofar as practicable with the consent of the Guest.
  • When arrangement of another accommodation cannot be made notwithstanding the provision of the preceding paragraph, The Lobs shall pay the Guest a compensation fee equivalent to the cancellation charges and the compensation fee shall be applied to the reparation. However, when The Lobs cannot provide accommodation due to reasons not attributable to The Lobs, The Lobs will not pay the compensation fee to the Guest.

Article 17. Handling of Deposited Articles

  • The Lobs shall compensate the Guest for damages when loss, breakage or other damage occurs to the goods, valuables or cash deposited at the front desk by the Guest, except in the case when this damage has been caused by force majeure.
  • However, for cash and valuables, when The Lobs has requested the Guest to clearly report the type and value thereof but the Guest has failed to do so, The Lobs shall compensate the Guest for the damage up to the maximum amount of 50,000 yen.
  • The Lobs will not be liable to the Guest for any of the goods, valuables or cash that the Guest has brought into The Lobs but not deposited at the front desk.

Article 18. Custody of Baggage and/or Belongings of the Guest

  • When the baggage or belongings of the Guest is or are found left behind at The Lobs after his/her check-out, such an article will be kept by The Lobs for a period of seven (5) days including the day when it is found, in principle. If the Guest has not asked The Lobs for return during that period, The Lobs will keep the article for a certain period thereafter and then dispose of it according to the laws and regulations of Japan. Food, beverages, magazines and other articles equivalent to wastes, not claimed for return by the Guest by the day after check-out, will be disposed of at the discretion of The Lobs.
  • Regarding the liability of The Lobs for the custody of the baggage or belongings of the Guest which is set forth in the preceding two paragraphs, the provisions of Paragraph 1 in the preceding Article 17 shall apply to a case of Paragraph 1 in this Article, and the provisions of Paragraph 2 in Article 17 shall apply to a case of Paragraph 2 in this Article.

Article 19.

Article 20. Non-Smoking

  • All rooms and other areas of The Lobs are non-smoking. (Some properties have no covered smoking spaces outdoors.)
    If the Guest or a person accompanying the Guest is found to smoke in the building and continues to smoke after being requested to stop, the Guest or accompanying person who has smoked may be evicted from the building without any refund.
  • If the Guest or accompanying person is found to smoke in the guest room, the Guest will be charged additional cleaning costs of JPY100,000 per night. Additionally, the Guest will be charged and shall pay all costs incurred in compensating later guests who are affected by The Lobs’s deodorization of the room to get rid of the smell of smoking, or relocating such a guest to another room as needed to keep him/her from the bad smell, pursuant to Paragraph 3 of Article 12 herein.

Article 21. Liabilities of The Lobs

  • If The Lobs has caused damage to the Guest in the course of fulfillment of or due to non-fulfillment of the Accommodation Contract and/or related agreements, The Lobs shall compensate the Guest for the damage; provided, however, that the same shall not apply in the case where such damage has been caused due to reasons not attributable to The Lobs.
  • The Lobs is covered by a Accommodation Liability Insurance in order to deal with unexpected fires and/or other disasters.

Article 22. Liability for Parked Vehicles

  • When the Guest uses the parking area of The Lobs, The Lobs will be lending a parking space but assume no liability for the storage and safekeeping of any parked vehicle; provided, however, that if the car is intentionally or unintentionally damaged as a result of The Lobs’s management of the parking area, The Lobs will assume liability for the same.

Article 23. Travel Insurance and Associated Liability of the Guest

  • The Lobs operates wholly in Japan, and the laws of Japan apply to all services provided. Where services are provided by agents, bookings are made subject to the Rules and Regulations of the agent or The Lobs.
  • Subject to applicable laws, The Lobs is not liable for any loss, damage, delay including air freight delay, consequential loss, injury or death, resulting from force majeure or unavoidable circumstances and due to reasons not attributable to The Lobs.
  • Guests are recommended to insure themselves against all risks of travel that can occur after confirmation of a booking by purchasing appropriate Travel Insurance at their own expense. Upon the booking confirmation, the Guests will be regarded as agreeing to assume such risks by themselves for use of the Accommodation.

Article 24. Revision of Terms and Conditions

  • These Terms and Conditions may be revised from time to time whenever necessity arises.
    When these Terms and Conditions are revised, The Lobs shall post on its website, or notify in the brochures provided in the guest rooms, the provisions and effective date of the revised version.

 

Rules and Regulations (updated April 10, 2020)

To ensure Guests’ safe and comfortable usage of the facilities and to preserve The Lobs’s public nature, The Lobs has established the following rules and regulations which are integral to the Terms and Conditions of Accommodation. In the event that violation of these Rules and Regulations occurs, The Lobs may terminate the Accommodation Contract pursuant to the provisions of Article 8 of the Terms and Conditions of Accommodation.

Extra Charges for Overtime Use of Guest Room

The extra charges pursuant to Paragraph 2, Article 10 of the Terms and Conditions of Accommodation are as follows:

  • Extended use charges
    • Up to Noon of the day of departure : 20% of the Room Rate
    • Up to 3:00 P.M. of the day of departure : 50% of the Room Rate
    • Beyond 3:00 P.M. of the day of departure : 100% of the Room Rate
  • Charges for early and late check-in times
    • Check-in After Noon of the day of arrival : 20% of the Room Rate
    • Check-in Before Noon of the day of arrival : 100% of the Room Rate

Number of Occupants of Guest Room

Occupancy of a guest room by more occupants than stipulated by The Lobs is not permitted in principle.
If, without prior application, the number of occupants of a guest room is found to exceed the contracted number, usage charges for the number of excess occupants will be billed.

Pets

No pets are allowed at The Lobs, either inside, outside or remaining in vehicles parked at The Lobs.
The Act on Assistance Dogs for Physically Disabled Persons will apply to use of such dogs as guide dogs, service dogs and hearing dogs.

Loss of Room Key(s)

The Guest who has lost a guest room key shall pay the full cost necessary for reissuing a new key.

 

The following acts are strictly prohibited on the premises of The Lobs:
Use of heating or cooking implements using fire, laundry iron presses except provided by The Lobs, and such other electrical appliances;

  • Generating noise such as loud singing, diffusing of offensive odors, or committing other acts repugnant or annoying to third parties;
  • Bringing any of the following articles onto the premises:
    • Animals including birds, etc. (except for guide dogs, etc.);
    • Statutory controlled substances including stimulants and narcotics;
    • Combustible or inflammable explosives and volatile fuels and hazardous chemicals harmful to human health;
    • Firearms, swords and such other articles in the absence of a license;
    • Articles in conspicuously large quantities or of extremely heavy weight;
    • Odor-emitting articles;
    • Refuse or items detrimental to guest room hygiene;
    • Items such as electrical or cooking appliances intended for use on the premises of The Lobs; and
    • Other items prohibited by The Lobs from being brought into guest rooms.
  • Engaging in any other acts detrimental to safety and hygiene on the premises of The Lobs.
  • Access to any facilities not intended for use by guests (except in cases of emergency or unavoidable situations).
  • Relocating or modifying of equipment and articles on the premises of the building, taking them outside the Building, or using such equipment or articles for a purpose other than originally intended.
  • Using hair coloring or de-coloring agents, etc., in the bathroom of guest rooms and in the public bath.
  • Burning incense in a guest room.
  • Leaving personal effects outside guest rooms.
  • Distribution of flyers and other advertisements to other guests.
  • Acts in violation of public order and morals.
  • For-profit activities.
